Academy Sues Man For Manufacturing, Selling Fake Oscar Statues Online

It may be Award season for all of Hollywood, but there is one man in America that won’t be up for an Oscar this year.

RadarOnline.com has exclusively learned that the Academy Awards filed a lawsuit on Feb. 6 against Texas man Jaime De La Rosa for manufacturing, importing, and selling fake Oscar statuettes on eBay and Etsy.

The Academy of Motion Picture Arts And Sciences “seeks injunctive relief and damages for copyright infringement, trademark infringement, trademark dilution, and false representation,” court papers obtained by Radar stated.

“De La Rosa operates (1) a store on the eBay Web site (ww.ebay.com) in the form of an online auction and shopping site under the username ‘jjleo0205 and (2) an online store on the Etsy Web site (www.etsy.com) under store name ‘QuietOnTheSet’ and user name ‘Jaime De La Rosa,’” the suit said.

The academy also sued 10 other individuals, but listed them in the paperwork against De La Rosa as “Does 1 through 10.”

According to the court papers, Does 1 through 5 “manufactured, imported, or procured counterfeit replica ‘Oscar’ statuettes for De La Rosa to sell in derogation of the Academy’s rights.”

Does 6 through 10 helped De La Rosa with the sale of the counterfeit statuettes.

The issue was first brought to the attention of the Academy in November 2013 when they found out about a listing on eBay called “Academy Award Hollywood Metal Movie Acting Trophy Prop Replica” with one of the fake statutes being sold for $850.

The Academy claimed that the contacted De La Rosa, but he continued to sell the replicas — one replica was even being sold for the price of $5,000 on his Etsy store.

The Academy sued De La Rosa for copyright infringement and is asking for an injunction against him to get him to stop selling the fake statues.

They are also demanding $150,000 in damages from the defendant.

“The Academy is entitled to recover three times the defendants’ profits and the Academy’s damages, reasonable attorneys’ fees, and the cost of this action,” the papers said.

'Winter's Tale' Reviews: Colin Farrell Stars In A Muddled Romantic Mess

Winter’s Tale” is one of the Valentine's day features vying for your attention this weekend.

Starring Colin Farrell and Jessica Brown Findlay — “Downton Abbey” fans will recognize her as the former Lady Sybil — as star-crossed lovers the film is first set in the early 1900s before fast-forwarding to present day. 

Farrell plays Peter Lake, a thief who captures the heart of Beverly Penn (Findlay) while on the run from his former mentor Pearly Soames (Russell Crowe). Lake then pops up in 2014, unaged and without an inkling of who he is, where he gets acquainted with another woman Virginia Gamely (Jennifer Connelly) while trying to sort out his identity.

By far, there's a lot going on in the nearly two-hour movie.

The first reviews for "Winter's Tale" are out today — never a good sign for a movie — and it's currently sitting at 11% on Rotten Tomatoes.

The movie is based on a hefty novel from Mark Helprin of the same name and comes from first time director Akiva Goldsman (he's written wonderful films like "A Beautiful Mind" and "Cinderella Man" and then "Batman Forever" and "Batman & Robin").

Warner Bros. spent a reported $75 million on the movie. Early estimates have the movie making $13 million over the weekend.

While figuring out which movie to see this holiday, here’s what what critics are saying about "Winter's Tale":

One of the problems with the film is the time-traveling aspect which detracts from the initial love story.

“There is an underlying plot of good versus evil; angels, demons and spirit guides drift in and out of the storyline clumsily. Then, there is the modern-day aspect, as well, which is perhaps the film’s least interesting aspect all together.”

“No doubt intended as an emotionalized and commercialized embodiment of Nietzsche's Eternal Return, the time-jumping set-up is so lacking in plausible narrative underpinnings that Goldsman would have needed to somehow seduce the audience into accepting the wild leaps the story takes. Without the needed persuasion, the strong temptation is just to reject the entire premise early on, which makes for a lot of eye-rolling, exasperated sighing and wristwatch glancing during the remaining long haul.” 

The Wrap

"The sparks between Farrell and Brown Findlay are undeniable, but “Winter’s Tale” gives us too little of their love story, opting instead to lose itself in magical mumbo-jumbo while at the same time trying to keep one foot in the real, recognizable world.” 

That seems to be a shame since it sounds like a romantic movie that just got caught up in itself.

“But provided you know what you're in for, the first chunk of Winter's Tale — the romantic part, before Peter is consigned to being a boring old Jesus figure — offers some modest escapist pleasures, not least thanks to Farrell's sweet, earnest intensity and the presence of a rather spectacular flying white horse.” 

Paste:

“The best part of this film is the tender performance of lovers Farrell and Findlay. There are a few moments, particularly near the opening, when it feels almost as though the actors went off script and created their own magical world.”

Then there’s a random Will Smith cameo where he plays a Satan-like character. 

THR: Smith suddenly sprouts dagger-sharp teeth at the climax of his worst-ever big-screen appearance. 

Variety refers to him as the “Fresh Prince of Hell Air.”

Fans of the book probably won’t be happy:

“Goldsman appears to have plucked key moments and images from the book and twisted them into a familiar iconography of spiritual/sentimental kitsch — hey look, a little girl with cancer — with no regard for the delicacy with which Helprin eased the reader into his fanciful universe.” 

Screencrush is especially brutal: 

“’Winter's Tale' makes 'Safe Haven' look like 'The Godfather.’ It is an absurd story adapted in the most dreary way possible, with lifeless performances, dull dialogue and laughable special effects. I need to cross-reference my files, but I think it is the worst major studio release with respected actors in five years. If any of us cared about our culture at all we’d be gathering our pitchforks and storming Hollywood now.” 

Despite all that, the film is visually appealing. 

Village Voice 

Some of Winter's Tale is just flat-out pretty enough to work. Beverly and her family own a glorious fairy-tale mansion perched at the edge of a frozen lake — the scene is winter wonderland central, a confection of dazzling, sparkly whiteness. … Winter's Tale, however imperfect,is that rare beast on the movie landscape: an unapologetic romance (for the first two-thirds, anyway), with attractive stars and special effects designed to give audiences something other than the experience of watching worlds get blown up.” 

THR:  

“One is struck by the exceptional opulence of the New York settings (particularly the vintage ones) overseen and/or created by production designer Naomi Shohan and visual effects supervisor Richard Hollander, the great care devoted to the changing backdrops and skylines dictated by the eras, and the beauty with which it has all been photographed by Caleb Deschanel.” 

From the one completely positive review for the film so far: 

“I found this well-crafted piece of magical realism quite imaginative and intriguing, though I suspect fans of the book might be a bit disappointed, given how much is ordinarily lost in translation bringing any 700-page book to the big screen. A searing, supernatural exploration of the human soul suggesting not only that love is real but that miracles happen, too!” 

Overall consensus: Skip.

It was never clear from any of the trailers what exactly this movie was about. “Winter’s Tale” looked like a romance that transcended time and space mixed with conflict from an outside source. Despite the star power of Russell Crowe and a potential dynamic love story between Farrell and Findlay's characters, a complex plot made this romance lose its magic.

If you’re looking for a Valentine’s Day date movie, we’re not too keen on any of the releases out this weekend, save maybe Kevin Hart’s comedy "About Last Night" which, at the least, should bring some laughs. Warner Bros.’ other release “The LEGO Movie” — which isn’t just a kiddie flick — would probably be a better alternative.

Legendary Comedian Sid Caesar Dead At 91

Sid Caesar Billy CrystalSid Caesar, the writer, actor and comedian who shaped American comedy from the early days of television is dead at age 91.

Larry King first announced the news via Twitter:

A representative for Carl Reiner, one of Caesar’s longtime collaborators, has since confirmed Caeser's death.

Caesar first started performing at a hotel in the Catskills before becoming well known for his TV series “Your Show of Shows” and “Caesar’s Hour.”

He also memorably played Coach Calhoun in the movie “Grease.”

Casear had more than 67 acting credits to his name before his death.

Here's How Rihanna Ended Up Nearly Bankrupt In 2009

Despite a red hot career, Rihanna was left nearly bankrupt by the end of 2009.

According to new legal documents obtained by TMZ, the singer claims she had $11 million in cash at the beginning of 2009  but was left with just $2 million by the end of the year. And it wasn't because of her shopping habit.

While $2 million may still sound like a lot for most, the problem is that the singer purchased a house priced between $7 and $7.5 million that year, which her accountant okayed. Rihanna ultimately ended up selling the property for a $2 million loss.

Rihanna also claims that her 2009 Last Girl On Earth concert tour was losing money, but her accountant failed to notify her of the losses.

The new legal docs were filed in connection with a 2012 lawsuit Rihanna filed against her accounting firm, Berdon LLP, claiming gross mismanagement.

Rihanna has said she hired Berdon LLP in 2005 when she was just 16-years-old and first launching her music career.

In the initial docs, the singer also alleged her accountants took an above-standard 22% commission from her.

The accounting firm, meanwhile, maintains its innocence, stating that it is Rihanna's "own financial action or inaction" or the actions of others working for her that caused her to lose millions of dollars.

Five years, three albums, and several spokesperson gigs later, Rihanna has rebounded quite nicely with what Forbes estimates to be a $43 million fortune.

Oscar-nominated actress Jessica Chastain looks like a dead ringer for Disney princess Merida in a new ad for Disney Parks.

Titled "Where Your Destiny Awaits," the ad is featured in the February issue of The Oprah Magazine.

It's the latest in a series from famed photographer Annie Leibovitz who has been shooting stars ranging from Beyoncé to Penelope Cruz in iconic Disney scenes since 2007.

See Comcast And Time Warner's Appalling Subscriber Numbers

The Comcast / Time Warner Cable merger is not a surprise when you see what's happening with subscriber numbers in the TV business.

These charts tell the story — and the give the depressing underlying logic to the deal.

First, traditional cable TV is dying. Dying slowly, but nonetheless dying.

By 2018, 1 in 5 Americans will simply no longer be watching traditional TV, according to Forrester, a research group:

Here is what that death looks like in terms of TV subscriptions being lost across all the major companies in the business.

Note that the business as a whole is no longer able to add new subscribers most quarters. People are leaving. (We're grateful to One Touch Intelligence for this data.)

The TV business has been taken by surprise by this trend. For example, Upon delivering his Q3 numbers, Tom Rutledge, CEO of Charter Communications (another cable TV firm), told Wall Street analysts he was "surprised" that 1.3 million of his 5.5 million customers don't want TV— just broadband internet. "Our broadband-only growth has been greater than I thought it would be," he said.

Now here is what that same data looks like at Time Warner and Comcast, specifically:

The key to this chart is that ALL the points on it are negative — the companies are only losing subscribers on a quarterly basis. But Comcast's trends are better than Time Warner's. Comcast seems to be reducing its losses as time goes by. Time Warner, by contrast, is a disaster area. Time Warner has lost internet subscribers as well as TV subscribers. Customers are bailing out of this sinking ship. 

So clearly, Comcast sees a weakness in Time Warner's business — making it ripe for acquisition.

Viewers are going online for video.

Where are those viewers going? To stream video on-demand, over the internet, from services like YouTube, Hulu, Roku, Aereo, Netflix, and illegal pirate streams. People just don't want to pay cable companies for TV any more, so they're buying connected/internet TVs, according to Business Insider Intelligence:

But why would Comcast want to acquire Time Warner's ailing business? Why not just compete against it? Especially as, for regulatory/competition reasons, the combined entity will have to give up  3 million more subs.

It's all about managed decline. Look at the top chart from Forrester again. It shows TV watchers in decline, but in a slow decline. This is a business that will be around for years, even if it won't be a happy business to be in. There will still be plenty of money to be made managing those margins on the way down.

Comcast is clearly better at managing the decline of its subscribers — note how its subs losses are much narrower than Time Warner's. That's likely because Comcast has gone all out to provide internet-like TV to its users. Comcast customers don't just get TV, they get broadband internet, an extensive on-demand menu of individual shows and movies, a large catalogue of free old movies, and an Xfinity mobile app that allows you to watch all the TV you want on your phone or tablet.

Comcast is probably thinking that if it can capture as many customers as it can from other companies — by regular competition or by acquisition — it can prolong the decline of TV much longer than if those customers are left in the hands, and ultimately lost by, less competent companies like Time Warner.

Hence the deal.

Here's the plot synopsis from Warner Bros.:

Tammy (McCarthy) is having a bad day. She's totaled her clunker car, gotten fired from her thankless job at a greasy burger joint, and instead of finding comfort at home, finds her husband getting comfortable with the neighbor in her own house.

It's time to take her boom box and book it. The bad news is she's broke and without wheels. The worse news is her grandma, Pearl (Sarandon), is her only option—with a car, cash, and an itch to see Niagara Falls. Not exactly the escape Tammy had in mind. But on the road, with grandma riding shot gun, it may be just what Tammy needs.

"Tammy" comes to theaters July 2.

FAKE STREETS, FAKE OCEANS, FAKE BRAD PITT: Here's What You See On The Paramount VIP Tour

Paramount Studios

Paramount Pictures is the studio responsible for hit films such as "The Wolf Of Wall Street," "Titanic," and the "Transformers" franchise, as well as TV shows like "Glee."

While most studios shoot their projects off-site, the majority of Paramount's projects are filmed right on the historic studio lot that still functions today in the heart of Hollywood. 

The studio offers tours for film and TV buffs, and we took the most intensive one available — "an in-depth, insider's experience, which includes access to Hollywood history and magic unavailable to the general public."

Four and a half hours later, here is everything we saw. As promised, it was magical.

Behold the iconic gates guarding Paramount Pictures — the oldest surviving studio still located in Hollywood.



This is what's known as "The Bronson Gate," which at one time was the main entrance to the studio. Many visitors ask if the gate was named for actor Charles Bronson, but it's actually the other way around: Bronson named himself after the gate!



Near the entrance is a screening theater where Michael Bay watched "Transformers" 31 times to tweak it before release.

Ben Affleck and Matt Damon seriously roasted each other in a new video that premiered today and is already going viral — but it's all for a good cause.

The BFFs have teamed up with fundraising site Omaze to benefit Affleck's East Congo Initiative and Damon's Water.org

For just $10, anyone can enter a contest that will make them eligible to win a trip to Los Angeles with a friend and a double date with Matt and Ben at a "very special" Hollywood event.

In the funny video promoting the contest, the duo behind "Good Will Hunting" totally slam each other, including "Gigli" digs.

But be warned, Affleck and Damon explain what going on a double date with them entails:

Affleck: "It will be like a best friend double date."

Damon: "Like us hanging out taking selfies, talking about how the Sox are going to do."

Affleck: "Or if you have more sophisticated interests we can talk about 19th century literature or politics in the Middle East ... or we could talk about the movie 'Argo,' which won Best Picture."

Damon: "Or we could talk about 'Good Will Hunting' and who did the bulk of the writing."

Affleck: "Or you could learn about things that are actually true, like how incredibly short Matt Damon is."

Damon: "Or the fact that Ben Affleck's left eye twitches every time you say the word 'Gigli'

Affleck: "Can we cut for a second?"

Paula Deen Lands $75 Million To $100 Million New Business Deal To Reboot Her Brand

Are y'all ready for Paula Deen's comeback?

After much controversy over racist remarks landed the celebrity chef in hot water this summer, Deen is trying to return to the spotlight.

Deen's new company, Paula Deen Ventures, has received an investment between $75 million and $100 million from Najafi Cos., The Wall Street Journal reports. 

Jahm Najafi, who owns the Book-of-the-Month Club, SkyMall magazine, and BMG Music Service, believes his Phoenix-based investment company can help Deen broker new deals by retiring her current business model, which sells her likeness and expertise to others.

Najafi, on the other hand, says, "Our investment allows the Paula Deen brand to expand their relationships and the partnerships that are already in place, and support those partnerships on a go-forward basis."

Steven Nanula, chief executive of Paula Deen Ventures, tells WSJ that the new company is already in talks with TV networks, retail chains, and other possible partners  her former home The Food Network, from which she was fired in June, is not among them.

Najafi believes that Deen's powerful social media presence is what ultimately will bring the TV chef back to the airwaves.

"The important thing to remember is that her fan base is rabid," he explained. "Her Facebook fan base has more than doubled in the past year. The Paula Deen brand is alive and well."

Deen's Twitter account, to which she regularly posts, has over 1.21 million followers. Her well-oiled machine of a Facebook page has over 4 million "likes" and posts recipes daily.

Speaking to WSJ via e-mail, Deen said it's the "hundreds of thousands of folks who signed up on Facebook's 'We Support Paula Deen' page" who have gotten her through the difficult year. She adds that"Hundreds of thousands of my fans sent me messages of love and support."

Deen posted another message of gratitude to her Facebook page earlier today:

Just wanted to say thank you to everyone for your kind words. I'm very excited about the journey that lies ahead, and can't wait to take y'all with me! Sending all of y'all love and best wishes from the bottom of my heart.

Comcast announced plans to acquire Time Warner Cable for $45 billion today, which would produce an absolutely massive company if approved.

In addition to being the largest cable provider in the U.S. with 23 million subscribers, Comcast owns a huge number of media and entertainment properties, especially since it completely acquired NBC Universal from GE in 2011.

A track star at the 1936 Olympic Games, Zamperini went on to serve in World War II, during which time the bomardier's plane crashed into the ocean and he survived for 47 days on a raft in shark-infested waters. Zamperini was eventually rescued by the Japanese, only to be held for two years as a prisoner of war.

The bestselling book "Unbroken" is based on Zamperini's life and Angelina Jolie is directing the film adaptation, due in theaters Christmas 2014.

It's been 27 years since the original "RoboCop" hit theaters.

Paul Verhoeven's 1987 R-rated classic gave us exaggerated gore, a vision of a crumbling Detroit, and one of the corniest — yet catchiest — taglines in "I'd buy that for a dollar."

With the remake in theaters this week, we're taking a look back at the original cast.

Most have gone on to star or cameo in other movies or television shows. 

A favorite among the cast are small roles on Fox series "24."

Sony Has Already Exceeded Its Playstation 4 Target With 5.3 Million Sold

TOKYO (Reuters) - Sony Corp said it has sold 5.3 million Playstation 4 game consoles as of February 8, surpassing its full-year target ahead of its release in Japan next week.

Sony had said that it hoped to sell 5 million units by the end of March after releasing the Playstation 4 on November 29 in the United States, Western Europe and Latin America and rolling it out across other Asian countries since then.

The console will go on sale in Japan on February 22, the last country currently scheduled to handle the device.

Microsoft Corp said in January that it had sold more than 3 million of its Xbox One console by the end of December after it was also released in late November.

What happens if you ever beat Candy Crush Saga, King's popular match-three game?

King, which filed to go public today, adds new levels to Candy Crush Saga roughly every two weeks, Business Insider has learned.

The last on-the-record level count is 485, but we've heard there are at least 500 now.

But when you actually beat the game, a whole lot of nothing happens. You simply see a congratulations banner, and then you wait a few weeks for the next update.

But if you simply can't wait, you can play Dreamworld, King's first major extension of the game. Any player who makes it past level 50 can access the new Dreamworld area by tapping Odus the Owl on the game map.

"It was like a Christmas gift for our players," King co-founder and Chief Creative Officer Sebastian Knutsson previously told Business Insider. "The majority of players are stuck at certain levels. Depending on where they are, they might feel frustrated. With Dreamworld, you can replay levels you've already beat and get rewarded with more content."

About 93 million people play Candy Crush Saga daily, according to KingCandy Crush Saga accounts for about 78% of King's revenue, which means the game pulled in about $1.46 billion last year.

Here's The History Of The Game That Was Copied To Create Candy Crush Saga

Candy Crush Saga has been so successful that it has allowed its maker, King to file for an IPO.

But everyone know that the basic underlying game inside Candy Crush is not original to King. Most people remember that before Candy Crush, Bejeweled was the dominant casual mobile game phenomenon.

Candy Crush owes a LOT to Bejeweled.

In fact, Bejeweled is still huge in mobile gaming. It is currently ranked 124th in Apple's App Store among free games — above Starbucks and LinkedIn, and thousands of other apps.

But even Bejeweled isn't the original match-three game. That honor probably belongs to a Russian computer game from the early 1990s called Shariki, or "the balls."

Here's the complete history of what the creaators of Bejeweled went through before Candy Crush came along.

Before Candy Crush Saga, there was Bejeweled ...

Bejeweled has been called the "Gone With The Wind" of games. It has been played by more than 500 million people around the world, and consumed an estimated 10 billion hours of play since 2000, according to PopCap, its maker.

And Bejeweled has spawned a vast array of copycat games, all based on the "match-three" genre that Bejeweled pioneered.

Most recently, Bejeweled was copied by King.com for Candy Crush Saga, which in turn has triggered millions more downloads. The success of Candy Crush is leading King toward an IPO.

That's how influential and powerful the Bejeweled format is.

Yet few people know the Bejeweled story.

Bejeweled's creators — Jason Kapalka, Brian Fiete and John Vechey — once offered to sell the franchise to Microsoft for just $50,000. Their offer was rejected. Ten years later, their company was bought by Electronic Arts in a deal worth $1.3 billion.

We asked PopCap to give us all the earliest photos they had from the birth of Bejeweled. The archive includes images of the founders from when they were unknown teenage game nerds, forgotten black-and-white versions of Bejeweled for the Palm Pilot, and a picture of Snackers the cat, who makes Easter egg a appearances in most versions of the game.

This is the greatest video game story ever told.

From 1995 to 2000, Kapalka worked at Total Entertainment Network (eventually bought by EA). Around 1998 or 1999, TEN decided it needed to jump onto a big new trend in online gaming: Bingo.

Kapalka remembers the conversation going like this:

Boss: “Jason, we’ve got a new project for you.”

Me: “But I’m still working on the Total Annihilation tournament.”

Boss: “Yeah, well, now we want you to do a java-based web bingo.”

Me: “… Bingo? Like, in bingo halls, with grandmas?”

In fact, Kapalka had been producing a shoot-'em-up game called ARC:

"It was a top-down, team-based shooter, a little bit like Counterstrike. With little saucers driving around shooting at each other. It was made by two kids in Indiana in some trailer park. Our business guys didn't know how to talk to them," Kapalka says.

john young Bejeweled"I was 28 or 29," Kapalka says. "They (Vechey and Feite) kind of looked like weird goofy kids from Indiana. They had long hair, glasses and dressed in dumb T-shirts. They kind of looked like the Hanson Brothers. They were too young to get into bars and all they wanted to do was go back to the offices and play games at TEN."

"At the time [gaming] really wasn't something you did. There was no indie scene for games in '98. We worked with them on that game, Arc."

TEN was eventually renamed Pogo, which was bought by EA. "I think I got maybe $30,000" in the buyout, says Kapalka.

This is Kapalka's first business card (at right).

"We didn't have much of a business plan, so we didn't think too much about it. We didn't get venture capital or investments. There was no real financing. We had some savings. It was just the three of us working out of our apartments," Kapalka says.

"We had enough money to go for 6 or 12 months maybe. That was as about as sophisticated as the plan got."

PopCap is born.

PopCap's HQ was Kapalka's San Francisco apartment at 526 Shrader Street. "It was kitty corner to Amoeba Records and the infamous Murio’s bar. It was a Victorian walk-up that was reasonably neat when I had roommates, but which got progressively more cave-like when they moved out. One room was nicknamed the 'crack den' because it was bare except for a ratty old mattress. (I didn’t actually do crack, though)," Kapalka says.

Snackers, who is 7 years old, has a cameo in just about every version of Bejeweled.

She’s in a flying saucer in Bejeweled Twist, and her head flies out and shoots laser beams if you get the rare "Cat’s Eye" gem in Bejeweled Blitz.

At the new company, Kapalka began researching color-matching games.

"John had found a puzzle game on the internet he thought was interesting. It was called 'The Colors Game.' I've never been able to find it again," Kapalka says.

"It had the same basic rules as Bejeweled, with matching three shapes, but there was no sound. You had to refresh your screen after every swap. It just a bunch of colored squares. I don't even think it had scoring. It didn't have instructions or credits."

"Match-three" games have a long history, Kapalka later discovered.

This is a Russian game called Shariki ("the balls") that was published online in 1994. Shariki is the ancestor of all match-three games:

The team initially thought a match-three "fruit" concept would be a winner. They were wrong!

"Brian started writing a more sophisticated version of Colors in Java, to put explosions in it. ... one problem was that they were squares, it was hard to distinguish them. I was trying to figure out what shapes we could use instead," Kapalka says.

"I tried fruits. In the game, you need seven different colors and shapes, and fruits are the same colors and the same shapes. So it was hard."

Gems, however, worked: Bejeweled was originally called 'Diamond Mine,' Kapalka says. "There were references to cave-ins and collapses, etc., but no one cared about the theoretical mining background."

But Diamond Mine was killed almost immediately — by Microsoft.

"We got a deal with Microsoft and they wanted it on their site, but under a different name. Their vague excuse was that there was some game called 'Diamond Mines' — plural — from the '80s and they were too close, legally. They wanted it to be exclusive to their site. We weren't thinking too much about long-term brand management!"

Here are the original instructions:

Microsoft wanted to use the name 'Bejeweled.' "At first I didn't like it. It seemed like a really lame effort to be topical and sound like the movie ['Bedazzled' starring Liz Hurley, below], and it would be dead in two months." Kapalka now admits, "It's more evocative than Diamond Mine."

"Microsoft agreed to rent Bejeweled for $1,500 a month," Kapalka says.

bejeweled on disks"We could see what it was doing on Microsoft's gaming zone, you could see the numbers of simultaneous players. It was easily the most popular game on their service. There were 20,000 simultaneous players, which was a lot in 2000."

PopCap offered to sell the game to Microsoft: "They wouldn't buy it outright. We would have sold it for sure, for $50,000 or less." But Microsoft wasn't interested, Kapalka says. "This was them being cheap."

So PopCap made a deal with Microsoft that it came to regret:

image002 BejeweledMicrosoft didn't own the game but they did own the name "Bejeweled," so PopCap made a deal: PopCap got the name back and in return Microsoft got the rights to create advertising-based versions of the game. There was a Tyson chicken Bejeweled. A Smirnoff Ice Bejeweled. Even one for the Pork Board.

"I remember thinking, this is so ridiculous, we should change the name to 'Beporked,'" Kapalka says.

"They'd re-skim the images of the jewels but it was difficult to get seven different pieces of pork. It was a source of mild embarrassment for a few years."

bejeweled palm 23With Microsoft paying $1,500 a month to license Bejeweled, Kapalka thought they had a business model.

"We thought, if we do a bunch more of these deals and get them all going at the same price, maybe we can make living."

Then PopCap began charging people $20 to play Bejeweled.

With Microsoft paying chump change, "we looked around for other ideas to make money," Kapalka says.

A friend suggested selling a full, downloadable version for $20 per user. It sounds crazy in hindsight, but most users were on telephone modems. Maybe they wanted bigger graphics. Maybe they didn't want to interrupt their games every time the phone rang.

They called the $20 version "Bejeweled Deluxe."

Amazingly, people were willing to pay $20 to play Bejeweled.

"We had a program that made a cash register 'ka-ching!' sound every time we made a sale. John was sitting on his couch and his mom was yelling at him that he couldn't make money sitting on the couch. And then the thing made a sound — 'ka-ching!'"

In fact, hundreds of people were willing to pay $20 for uninterrupted games of Bejeweled, and the ka-ching! program rang frequently. "We had to turn it off because it became more and more noisy. It made thousands, which was quite a bit for three guys in a basement."

Microsoft worried that ad-free downloadable games would cannibalize the ad-supported version of Bejeweled.

So PopCap agreed to split download revenues 50-50 with with Microsoft.

"It did very well, and they said, 'oh this is a lot more money than the advertising model!'" Kapalka says.

"From 2000 to 2008, until the rise of the iPhone, that was largely the model for the industry. It was primarily PC-based casual games, play for free and then register for $20. That was a pretty stable industry for quite some time, until the rise of Facebook and iPhone, which gave a lot of other options for those players — classic soccer moms, bored secretaries and grandmas."

Motorola RazrIn 2004, the era of mobile gaming was born: Bejeweled came as a free, built-in feature of the Motorola Razr — the hottest cellphone of the day.

"We signed a licensing deal and didn't think about it much," Kapalka says.

"The amount of money you got paid for it was really small, it was cents per app. You had to go through multiple layers of bureaucracy. Jamdat, the carriers, they could charge whatever they liked, upwards of 70% from a user. It was good exposure but it took a while before it would add up to significant amounts of money."

"We went from paying up to 90% of our fees to the middle men [in order to get placement on a phone], to Apple's App Store cut, which is just 30%. And it was drastically easier for people to find and download games," Kapalka says.

"We were one of the launch games with the iPhone."

The iPhone was also crucial because its touchscreen was perfect for Bejeweled gameplay. On dumbphones, players had to punch cursor arrows. Swiping on the iPhone made the experience smoother.

In 2011, a decade after Microsoft had turned down Bejeweled's $50,000 offering price, EA agreed to acquire PopCap in a deal worth $1.3 billion.

"There were six months maybe, we were in some fairly intense negotiations with a couple different companies," Kapalka says.

"It was a lot of money. But PopCap was doing well enough that financially I was OK. ... It didn't change my lifestyle much. I made some donations to some charities and my old university, and stuff like that. There were some people at PopCap who got a fairly large check. If you get a check for a million when you're making $60,000 or $80,000 it's a large change."

"It's no worse than any of the others [games that have copied Bejeweled]. They have done some stuff that's pretty interesting … I kind of wish I'd thought of some of that stuff. I try to be philosophical about rip-offs. As long as they're adding something new."

"They have a very aggressive monetization scheme in there. It gets pretty hard, pretty fast if you're not spending money. It can lead to burnout."

"The ones that really annoy me are total clones that degrade the experience."

"Every once in a while I think, how much jewel swapping can I handle? How can I make Bejeweled feel fresh to me again?"

That's how new versions of Bejeweled get born.

Colin Farrell's Romantic Movie 'Winter's Tale' Bombs — Here's Your Box-Office Roundup

No one wanted to go out and see Colin Farrell's Valentine's Day flick "Winter's Tale."

The Warner Bros.' picture flopped over President's Day weekend bringing in $8.1 million. 

The film was estimated to cost $60 million to produce.

In comparison, both of Kevin Hart's releases — "Ride Along" and "About Last Night" — made more than $10 million for the 4-day weekend and one of them has been in theaters for five weeks.

"Winter's Tale" follows a trend of Farrell films that don't perform well when he's the lead. Granted, it was difficult to believe Farrell, who's 37, to play a 21-year-old in this film, but romance movies and action flicks like "Dead Man Down" and "Total Recall"* haven't performed well for the star.  

On the flip side, quirky cult films like "Seven Psychopaths" and "In Bruges" are his strong suit, despite not receiving wide acclaim. You can't write the star off completely since he has been in recent hits including "Horrible Bosses" and "Saving Mr. Banks."

Here are this week's winners and losers at the box office:

10. Zac Efron's "That Awkward Moment" rounds out the top ten in week three with $3.9 million. The Focus Features comedy has made a total of $21.9 million.

9. "Lone Survivor" is still going strong after two months in theaters adding another $4.7 million to its $119 million haul.

8. Here's how much  power Disney's "Frozen" still has at theaters. The animated flick nearly beat out Colin Farrell's Valentine's Day flick in its 13th week with $8 million. "Frozen" is on its way to $1 billion worldwide with more than $957 million.

7. Colin Farrell's "Winter's Tale" made a disappointing $8.1 million opening weekend. 

6. Kevin Hart's "Ride Along" actually saw a bump from last week with $10 million. The $25 million Universal movie has made $120.9 million worldwide.

5. Teen romance "Endless Love" brought in $15 million opening weekend. The '80s remake starring Alex Pettyfer ("Magic Mike") cost an estimated $20 million.

4. Sony's "The Monuments Men" more than doubled earnings for "Winter's Tale" with $18 million in week two. George Clooney's World War II movie has made $55 million worldwide.

3. The "RoboCop" remake bowed to Kevin Hart with $25.6 million. That figure fell in line — and above most tracking estimates for the Sony film. The studio will make most of its money overseas on this film. "RoboCop" has already made $69 million abroad.

2. It's pretty tough to deny that Kevin Hart is box-office gold now. His latest comedy "About Last Night" brought in a big $28.9 million over the four-day weekend.

1. The big winner for the weekend was "The LEGO Movie." While that wasn't a surprise, the movie made an astronomical $63.5 million in week two. That's only an 8% drop from its opening weekend. The Lego film will cross the $200 million mark this week.

*Note: While "Total Recall" wasn't a box-office hit domestically, it performed better overseas.

This Teenager On Instagram Is A Dead Ringer For Benedict Cumberbatch

If you take a look at 16-year-old Tyler Michell's Instagram account, you'll see nothing out of the ordinary at first.

The British high school student is like any other teenager on Instagram, posting selfies for the world to see. But look closer, and you may wonder why he looks so familiar.

Michell is a dead ringer for  "Sherlock" star, Benedict Cumberbatch. The teen gained notoriety by posting selfies on Instagram with hashtags like #benedict, #cumberbatch, #sherlock.

With over 13,000 followers, Michell has fans from the UK to China (many of the comments on his photos are in Chinese) and the count just keeps getting higher.
